ABSTRACT
In the article reproduced below, H.L.A. Hart considers at length the positivist’s claim that there is no necessary connection between law and morality. He seeks both to clarify what exactly the separation thesis means and to defend it against some common criticisms to which it was subject. Those criticisms were raised most forcefully by Harvard professor Lon Fuller, whose views are presented in the second reading in this section.
