ABSTRACT

The Indian Constitution and the judiciary play a significant and remarkable role in striking a balance between the equity and equality of its people. They are the responsible custodians of human values, which is prerequisite in a society to live a life of dignity and honor. One of the main features of the Indian Constitution is equity and equality. It indicates that every individual should enjoy equal opportunities in terms of the sharing of natural resources, school education, health care facilities, nutrition, participation in different decision-making bodies, representation from the community and expression of their views if their interests are not protected in any policies or programs. However, in reality, there is a gross violation of both equity and equality. It is the responsibility of every nation to take appropriate measures to achieve its goals and to secure the rights of its people through proper co-ordination and planning with the relevant agencies. The concerns of the State are greater than that of any individual and the enforcement of the law is absolutely essential, else its validity would break down and it would lose its respect. This chapter presents a broad discussion on ensuring equity and equality while upholding justice and lays out the overview of the volume.
